1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of ShiftSelling.com (the “Site”) and any coaching, consulting, workshops, speaking engagements, or related services offered by Shift Selling Inc. (“Shift Selling,” “we,” “us,” or “our”) (collectively, the “Services”). By accessing the Site, purchasing Services, or submitting payment, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase the Services.

2. About Shift Selling Inc.

Shift Selling Inc. is based in Calgary, Alberta, Canada, and provides sales training, coaching, and consulting services built around the Trigger Event Selling™ and Window of Dissatisfaction™ methodologies developed by Craig Elias.

3. Description of Services

Shift Selling provides paid coaching, consulting, workshops, and speaking engagements (the “Services”) delivered by Craig Elias and/or associates, in formats that may include one-on-one sessions, group sessions, virtual or in-person meetings, and related materials. Specific scope, format, schedule, and deliverables for each engagement will be confirmed with the client at the time of booking (by email, proposal, or invoice).

4. Payments and Billing

  • All fees for Services are quoted in United States dollars (USD) unless otherwise stated in writing.
  • We accept payment by credit card, cheque, e-Transfer, and Electronic Funds Transfer (EFT). Credit card payments are processed securely through Stripe or Moneris; cheque, e-Transfer, and EFT payments are arranged directly with us using the instructions provided on your invoice.
  • By submitting payment, you authorize Shift Selling Inc. to process payment using the method you select, including (for credit card payments) charging the card via Stripe or Moneris for the agreed fees.
  • Full or partial payment (deposit) may be required in advance of scheduling or delivering Services, as specified at the time of booking.
  • You are responsible for providing accurate billing and payment information. Shift Selling Inc. is not liable for issues arising from inaccurate payment details you provide.
  • Applicable taxes will be added to invoices where required by law.

5. Cancellations and Refunds

  • Coaching/consulting sessions: Cancellations or rescheduling requests must be made at least 48 hours before the scheduled session. Cancellations made with sufficient notice may be rescheduled at no charge.
  • Late cancellations or no-shows: Sessions cancelled with less notice than required, or missed without notice, may be forfeited and are non-refundable.
  • Refunds: Because Services involve the delivery of professional time, expertise, and preparation, fees are generally non-refundable once a session has been delivered or a coaching/consulting engagement has commenced. Refund requests for undelivered Services (e.g., a package paid for but not yet started) will be considered on a case-by-case basis at our discretion.
  • Disputes/chargebacks: If you believe you were charged in error, please contact us before initiating a chargeback or payment reversal, so we can resolve the issue directly.

6. No Guarantee of Results

Shift Selling provides sales training, coaching, and consulting services designed to improve skills, strategy, and processes. We do not guarantee any specific business outcome, sales result, revenue increase, or financial result from participation in our Services. Results depend on many factors outside our control, including your own effort, market conditions, and execution.

7. Intellectual Property

All content on the Site and provided as part of the Services — including but not limited to the Trigger Event Selling™ methodology, Window of Dissatisfaction™ framework, the Traction Canvas, written materials, videos, templates, slide decks, and the Shift! book content — is the intellectual property of Shift Selling Inc. and/or its licensors, and is protected by copyright and trademark law.

You may not copy, reproduce, distribute, resell, or create derivative works from any Shift Selling materials without our prior written consent. Purchasing Services grants you a personal, non-transferable license to use provided materials for your own internal business purposes only.

8. Confidentiality

Information shared by you during coaching or consulting engagements will be treated as confidential and used solely to provide the Services, except where disclosure is required by law or you provide written consent to share it.

9. User Conduct

When using the Site or participating in Services, you agree not to:

  • Provide false or misleading information;
  • Use the Site or Services for any unlawful purpose;
  • Interfere with the security or proper functioning of the Site;
  • Infringe on the intellectual property or privacy rights of Shift Selling Inc. or others.

10. Limitation of Liability

To the maximum extent permitted by law, Shift Selling Inc., its directors, officers, and associates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or the Services, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid to Shift Selling Inc. for the Services giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Shift Selling Inc. and its associates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site or Services.

12. Third-Party Services

The Site uses Stripe and Moneris to process credit card payments. Your use of Stripe’s payment services is subject to Stripe’s own terms and privacy policy, and your use of Moneris’s payment services is subject to Moneris’s own terms and privacy policy. Cheque, e-Transfer, and EFT payments are handled directly by Shift Selling Inc. and do not involve Stripe or Moneris. Shift Selling Inc. is not responsible for the acts or omissions of Stripe, Moneris, our financial institution, or any other third-party service provider.

13. Termination

We reserve the right to suspend or terminate your access to the Site or Services at our discretion, including for violation of these Terms, without prejudice to any fees already owed.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Calgary, Alberta.

15. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Continued use of the Site or Services after changes take effect constitutes your acceptance of the revised Terms.
